GLOW — AI Skincare Analysis

These Terms of Service (“Terms”) constitute a legal agreement between you (“you” or “User”) and Peyton (“we,” “us,” or “our”) governing your access to and use of the GLOW mobile application and related services (collectively, the “App”).

By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the App.


1. Medical Disclaimer

THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

The information, analysis, scores, routines, product recommendations, and other content provided by the App are intended for general informational and educational purposes only. The App uses artificial intelligence to analyze photos of your skin and provide skincare guidance. This AI-based analysis:

You should always consult a qualified healthcare professional before starting, changing, or stopping any skincare treatment. If you have a medical skin condition (including but not limited to eczema, psoriasis, rosacea, cystic acne, skin cancer, or any condition requiring medical treatment), you should seek professional medical care.

If you believe you have a medical emergency, call 911 or your local emergency services immediately.

The skin scores, concern assessments, routine recommendations, and product match ratings provided by the App are generated by AI algorithms and are intended as general wellness and cosmetic skincare guidance only. The App is designed to help you self-manage your general skincare routine and make informed cosmetic product choices. It does not diagnose any disease or medical condition, prescribe any treatment, and does not claim to prevent, cure, mitigate, or treat any disease. Individual results may vary. We make no guarantees regarding the accuracy, completeness, or effectiveness of any analysis, recommendation, or information provided through the App.

No Guarantee of Results: We do not guarantee that using the App or following its recommendations will result in any specific improvement to your skin health, skin score, or appearance. Skincare outcomes depend on many factors beyond the App's control, including genetics, environment, diet, lifestyle, and individual product interactions.

AI Limitations: AI analysis may be less accurate in certain conditions, including but not limited to: poor lighting, low camera quality, certain skin tones, heavy makeup, facial hair, or uncommon skin conditions. The App's AI has not been validated across all demographics or skin types, and results may vary by individual. You should not rely solely on the App's analysis for any skincare decision.

Assumption of Risk: By using the App, you acknowledge that you understand the limitations of AI-based skincare analysis and voluntarily assume the risk associated with reliance on AI-generated skincare recommendations. You agree that any decisions you make regarding skincare products or routines based on the App's output are your own responsibility.


2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 13 years old (or 16 years old if you reside in the European Union) to create an account and use the App. If you are between the ages of 13 (or 16 in the EU) and 18, you must have the consent of a parent or legal guardian to use the App, and your parent or guardian must review and accept these Terms on your behalf.

We do not knowingly collect information from individuals under the age of 13 (or 16 in the EU). If we discover that a user is under the applicable minimum age, we will terminate the account and delete associated data.

2.2 Account Registration

To access certain features of the App, you must create an account. You agree to:

We reserve the right to suspend or terminate your account if any information you provide is inaccurate, incomplete, or violates these Terms.


3. Subscriptions and Payments

3.1 Free and Premium Features

The App offers limited free functionality and premium subscription plans that unlock additional features including unlimited skin scans, unlimited product scans, personalized routine generation, AI chat assistance, and progress tracking.

3.2 Subscription Plans

We offer subscription plans which may include weekly and annual options. All material terms of the subscription — including the price, billing frequency, auto-renewal terms, and cancellation method — are clearly displayed to you before you confirm any purchase. You will not be charged until you have reviewed and affirmatively consented to the subscription terms. Pricing is subject to change; however, any price changes will not affect active subscription periods.

3.3 Free Trial

Some subscription plans may include a free trial period. Before the free trial begins, you will be clearly informed of the subscription price that will be charged upon trial expiration and the date on which charging will begin. If you do not cancel your subscription before the end of the free trial period, your subscription will automatically convert to a paid subscription, and your payment method will be charged. You must cancel at least 24 hours before the end of the free trial period to avoid being charged.

3.4 Billing, Renewal, and Cancellation

Payment is charged to your Apple ID account (or Google Play account) upon confirmation of purchase. Paid subscriptions automatically renew at the end of each billing period unless you turn off auto-renewal at least 24 hours before the end of the current period. Cancellation is available at any time through your device's App Store subscription settings — the same method used to subscribe. We do not require phone calls, chatbot interactions, or any additional steps beyond your App Store account settings to cancel. You can manage and cancel your subscriptions through your device's App Store account settings.

3.5 Refunds

All payments are processed through Apple's App Store (or Google Play Store). Refund requests are subject to the applicable store's refund policies. We do not directly process refunds. To request a refund, please contact Apple Support or Google Play Support, as applicable.

3.6 No Contingency on Future Features

Your purchase of a subscription is not contingent on the delivery of any future functionality or features, nor dependent on any oral or written public comments we may make regarding future features.


4. Your Use of the App

4.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a personal device that you own or control, solely for your personal, non-commercial use.

4.2 Restrictions

You agree that you will not:

5. Intellectual Property

5.1 Our Ownership

The App and all content, features, functionality, software, text, displays, images, and design elements (collectively, “Content”) are owned by us, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The GLOW name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use these marks without our prior written permission.

5.2 Your Content

You retain ownership of any content you submit or upload to the App (such as photos and chat messages). By submitting content to the App, you grant us a limited, non-exclusive, royalty-free license to use, process, store, and display that content solely for the purpose of providing and improving the App's services to you. This license terminates when you delete the content or your account.


6. AI-Generated Content Disclaimer

The App uses artificial intelligence to generate skin analysis results, skincare routines, product recommendations, ingredient assessments, and chat responses. You acknowledge and agree that:


7. Product Recommendations and Third-Party Products

We are not the manufacturer, seller, distributor, or retailer of any third-party products recommended through the App. We do not warrant or guarantee the safety, efficacy, quality, or suitability of any recommended product. Product recommendations are generated by AI based on general ingredient science and your skin profile data, and should not be considered endorsements or warranties of any product's safety for your individual use.

Product recommendation limitations: The App's AI recommendations are based on publicly available ingredient data and general skincare science. They do not account for manufacturing defects, contamination, mislabeled ingredients, formulation changes by product manufacturers, product expiration or degradation, individual genetic factors, interactions between multiple products used simultaneously, or undisclosed ingredients. We strongly recommend that you read the full ingredient label of any product before use, perform a patch test on a small area of skin at least 24-48 hours before full use, consult a dermatologist or allergist if you have known allergies or sensitivities, and discontinue use immediately if you experience any adverse reaction.

If the App provides links to purchase products from third-party retailers, those purchases are governed by the retailer's own terms of service and policies. We are not responsible for any transactions between you and third-party retailers, and we receive no compensation that influences which products the AI recommends.


8. User Conduct and Safety

You acknowledge that the App is designed for cosmetic skincare guidance and is not suitable for evaluating, diagnosing, or monitoring medical skin conditions. You agree to:

Pregnancy and Nursing Warning: If you are pregnant, nursing, or planning to become pregnant, you should consult your healthcare provider before using any skincare products, including those recommended by the App. Certain skincare ingredients (such as retinoids, salicylic acid, and others) may not be appropriate during pregnancy or while nursing.

Allergies and Sensitivities: The App's ingredient analysis is based on general ingredient science and publicly available data. It may not account for all possible allergic reactions, individual sensitivities, cross-contamination risks, or interactions between products. Always perform a patch test when trying a new product and consult an allergist or dermatologist if you have known allergies or sensitivities.


9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

YOUR USE OF THE APP IS AT YOUR SOLE RISK. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR WARRANTIES ARE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.


10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, LICENSORS, SERVICE PROVIDERS, OR ANY OF OUR OR THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY:

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

You agree to defend, indemnify, and hold us harmless from and against any claims, actions, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

We may suspend or terminate your access to the App at any time, with or without cause and with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive behavior, or for any other reason at our sole discretion.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us at the email address in Section 18. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts of competent jurisdiction in Mecklenburg County, North Carolina.

Class Action Waiver: To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.


15. Export and Sanctions Compliance

The App may be subject to U.S. export control laws and regulations. You represent and warrant that you are not located in any country or region that is subject to a U.S. government embargo and are not listed on any U.S. government list of prohibited or restricted parties.


16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App, superseding any prior agreements.

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, internet outages, power failures, or third-party service provider outages.

16.6 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights, except that Apple Inc. and Google LLC (and their subsidiaries) are intended third-party beneficiaries of these Terms with respect to their respective platforms, with the right to enforce these Terms against you.

16.7 Electronic Communications

By using the App, you consent to receive communications from us electronically, including via email, in-app notifications, and push notifications (where enabled). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.


17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the “Last Updated” date at the top of this page. For significant changes, we may provide additional notice through email or an in-app notification.

Your continued use of the App after such changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the App and delete your account.
